CITY OF ORMOND BEACH HISTORIC REFUSAL
TO NEGOTIATE WITH TEAM ARNIE B. GREEN
ASSOCIATES, INC.

The City of Ormond Beach has refused to enter into negotiations separate and apart from a competitive bidding process with Arnie B. Green Associates, Inc. since 2007 for its proposed aeronautical use project on the Ormond Beach Municipal Airport.  While the City is not obligated to agree to Arnie B. Green Associates, Inc.'s proposal the Grant Assurances and other FAA policy do require it to negotiate in good faith with a qualified party seeking access to the Airport to provide aeronautical facilities in response to aeronautical demand.  Further, the City of Ormond Beach must negotiate with Arnie B. Green Associates, Inc. in a manner that is consistent with its Federal commitments.  The City has failed to comply with its Federal obligations by working in an unreasonable manner to deny Arnie B. Green Associates, Inc. reasonable access to the Airport.

The City of Ormond Beach repeatebly asserts that Arnie B. Green Associates, Inc. is not qualified.  However, emphasizing the City's professed concerns does not explain or validate them.  In fact, the substantial evidence submitted to the City of Ormond Beach during the competitive bidding process, is clear and unambiguous:  Arnie B. Green Associates, Inc. and its team are professionally qualified and have the technical ability and experience to perform the proposed aeronautical services and/or other related facilities and amentities on the Airport.

FINANCIAL AND TECHNICAL SKILLS FOR SUCCESS

Arnie B. Green Associates, Inc. has the financial capability and resources to fully bond surety (investment equity) and performance (construction guarantees) for each phase of its proposed development project, subject to the acceptability of memorandum of understandings, development and lease contract documents, bond forms and other financing.  Clearly, Arnie B. Green Associates, Inc.'s posting of those bonds ensure that the City of Ormond Beach and the aeronautical community operating on the Airport are protected from financial risk.

There can be no doubt that Arnie B. Green Associates, Inc.'s qualifications and its technical ability demonstrate that it can manage the development and construction of the project and operate the Fixed Based Operation.  There is no reasonable grounds based on generally accepted industry standards and criteria and/or Federal and state licensing requirements for the City of Ormond Beach to claim otherwise.
CITY OF ORMOND BEACH USES AD HOC, ARBITRARY AND SUBJECTIVE STANDARDS DENY ACCESS TO
TEAM ARNIE B. GREEN ASSOCIATES, INC.

In the RFP process, the City of Ormond Beach unjustly and unreasonably demanded Arnie B. Green Associates, Inc. satisfy its incoherent, ad hoc, arbitrary and subjective standards, which the City did not require any other potential lessees at the Airport to demonstrate, in order to demonstrate that it was "qualified" to undertake the project.  The City of Ormond Beach then used these standards to claim that Arnie B. Green Associates, Inc. was unqualified and to justify its refusal to enter into negotiations.  For all its frenzied emphasis on Arnie B. Green Associates, Inc.'s alleged lack of qualifications, the City of Ormond Beach has failed to demonstrate any reasonable standard for reaching that conclusion.

It has been well over five (5) years since Arnie B. Green Associates, Inc. and its private investors first approached the City of Ormond Beach with its proposal to provide aeronautical services to the public at the Ormond Beach Municipal Airport.  The extended period of time and delays in entering into negotiations between Arnie B. Green Associates, Inc. and the City is unjustly discriminatory.  If the City of Ormond Beach's motive is to sit back and wait for a "better deal" as compared to Arnie B. Green Associates, Inc.'s proposal and its team of professionals, it is in violation of its Federal grant assurance obligations.
