While the City is not obligated to agree to our proposal, FAA regulations do require it to negotiate in good faith with the Company and in a manner that is consistent with the Federal commitments it made when the City of Ormond Beach accepted over $5.0 million in federal grants from the United States of America taxpayers for the Airport.

We're not saying that because we're showing up on their doorstep that we are entitled to some type of lease, but what we're saying is they have to sit down and negotiate with us and provide reasonable access to the Airport.

If they don't, the City jeopardizes the Federal investment in the Airport.

The next step will be for federal officials to determine if they can help bring the parties together.  If they are not successful, the developer will be free to file a formal complaint against the City with the FAA Administrator in Washington, DC.

The City could potentially lose over $5.0 million in past federal grants if the FAA finds that the City's failure to negotiate violated FAA regulations.
