The City of Ormond Beach's Washington, DC attorney files its response to the Part 13 Informal Complaint filed by Arnie B. Green Associates, Inc. against the City of Ormond Beach with the FAA.

SEPTEMBER 12, 2012

Arnie B. Green Associates, Inc. attorney's writes to the City of Ormond Beach's Washington, DC lawyer and offer the Company's:

"consideration to relocation/modification of its September 2011 phased site layout plans contained within its original proposal to provide aeronautical services to the public on either the Northwest, Northeast or Southeast Quadrant of the Airport, where there is more than sufficient acreage (land) available for Green's September 2011 aeronautical use proposal.  If the City is now reviewing its options for development and has not decided how it will proceed with respect to the 87-acre site located on the Southwest Quadrant of the Airport, Green wishes to offer thes other sites as viable alternatives for his proposal."

SEPTEMBER 14, 2012

Arnie B. Green Associates, Inc. attorney's writes to the City of Ormond Beach's Washington, DC lawyer to offer the Company's request that:

"...discussions include negotiations to reach a Memorandum of Understanding ("MOU") between the parties, which would define the framework moving forward to:

(1) achieve a development agreement;

(2) provide assurances that Green could complete the project; and

(3) memorialize the terms upon which to form an agreement for a potential long term lease agreement with the City."

SEPTEMBER 21, 2012

The City of Ormond Beach's Washington, DC lawyer responds to Arnie B. Green Associates attorney's inquires relating to additional land available for development on the Airport and request for discussions to reach a Memorandum of Understanding.  He states:

"The Selection Committee unanimously agreed to recommend to the City Commission reject Green's proposal.  The City Commission subsequently voted unanimously to reject Green's proposal.

As for the Northwest Quadrant and Southwest Quadrant, which has the VOR, the City's position is that these areas are not currently suitable for development and no date has been set for when these areas might become suitable for development..."
JUNE 12, 2012

Arnie B. Green Associates, Inc. attorney's sends to the City of Attorney of Ormond Beach, the second of two letters attempting to schedule a meeting between the Company and the City as well as its law firm in the hopes of informally discussing the exclusion of the Company from the Airport, the City's Federal grant assurance obligations and other FAA policy to negotiate in good faith with the Company.  The City Attorney did not respond at all to the second letter.

JUNE 20, 2012

Arnie B. Green Associates, Inc. attorney's speaks to the Assistant City Attorney of Ormond Beach, requesting the City Attorney respond to its May 9 and June 12, 2012 correspondence and requests that the City Attorney return its phone call.  The City Attorney did not respond to this request.

JUNE 29, 2012

Arnie B. Green Associates, Inc. attorney's files a Federal Aviation Administration (FAA) Part 13 Informal Complaint on behalf of the Company against the City of Ormond Beach with the FAA Airports Compliance Office, FAA Southern Region, Atlanta, GA.

The purpose of the Complaint is to seek the FAA's guidance and assistance with the application of law, regulation and policy, on an airport sponsor's (City of Ormond Beach) obligation to allow qualified parties access to a public airport.

The Complaint asks that the FAA intercede and instruct the City that it has an obligation under the Grant Assurances and other FAA policy to negotiate in good faith with Arnie B. Green Associates, Inc. for the development of an Fixed Based Operation and other aeronautical services at the Ormond Beach Municipal Airport.
